MPs angered by illegal clearing of aspirants

MPs are furious that several bodies are collecting millions of shillings in clearing aspirants for political positions without any legal backing.

Joint Chief Whips Johnstone Muthama and Jakoyo Midiwo said the bodies do not have the legal mandate to clear aspirants, as the requirements were deleted from rules regulating elections.

Several aspirants have been parting with money to obtain clearance from the National Credit Reference Bureau, Higher Education Loans Board (Helb), Kenya Revenue Authority and Criminal Investigations Department.

Gazette regulations

The legal requirement giving such bodies the power was removed by the Cabinet and Parliament from the Leadership and Integrity law. An attempt to re-introduce it in the elections regulations was defeated by the MPs.

On Thursday, Transport Minister Amos Kimunya agreed that indeed the requirements were removed from the laws governing elections, but pointed out that it is political parties that have been asking their candidates to seek clearance from the bodies.

“Some political parties have asked aspirants to have the clearances but the regulations we passed removed those clearances,” Kimunya, who is the Deputy Leader of Government Business, told the House.

Turkana MP Ekwe Ethuro wanted the regulations published. But Kimunya said it is the role of the Independent Electoral and Boundaries Commission (IEBC) to gazette the regulations.

Muthama had sought a ministerial statement on the matter from the Minister for Justice Eugene Wamalwa, saying the bodies are engaging in an illegality.
